                    Sexual Harassment Questionnaire
                        Discussion Leader Guide

[] You should note that these are intended to prompt questions and
discussion, illustrating a variety of circumstances in which
discrimination/harassment is present, or potentially present. Rather
than definitively setting out concrete, clear-cut examples, they are
intentionally vague. As a result, minor variations may transform some
situations from an innocent, pleasant social exchange to an offensive,
illegal confrontation.

Read the following and decide if each situation illustrated represents
a potential case of sexual harassment in the workplace.

Sexual Harassment?

yes no don't know 1. At a business meeting of his professional
staff the lab manager asks the only woman
engineer present to serve the coffee.
1. No. However, this is a form of sex discrimination. There is no
reference to sexuality.

yes no don't know 2. Every morning the boss comes in and hugs
all the women in the office. He says "I'm
                          just a very affectionate person."
2. Possibly. At this point there is the potential for this conduct
to escalate to sexual harassment. We have an insensitive boss, but
we do not know if his `hugs' are unwelcomed.

yes no don't know 3. Sharon's boss asks her to join him for a
drink after work to discuss her new job
                          assignment.
3. Possibly. Here again, at this point there is the potential for
this conduct to escalate to sexual harassment. The boss could have
chosen to meet at work.

yes no don't know 4. Shirley's boss offers her a promotion if
she'll go out with him. She accepts and as
a result receives the promotion she and two
other women in the office were vying for.
4. Yes. As to Shirley, this is quid pro quo sexual harassment, should
she challenge her boss's demands for awarding the promotion. If he
made similar demands upon the other women which were rejected, this
would be quid pro quo harassment as to them. Even if no demands were
made upon the others, they might have a claim for "sexual favoritism,"
in that sex played an improper role in their having been denied an
employment opportunity for which they were qualified.

yes no don't know 5. Jane applied for a job that required
extensive travel. She was turned down
because the out-of-town trips required her
to travel with two male employees.
5. No. However, this is a form of sex discrimination.

yes no don't know 6. One of the secretaries in Bob's office put
up the center-fold picture from Playgirl
magazine. The nude male picture displayed
on the wall disturbs Bob whenever he
                          looks at it.
6. Yes. Assuming Bob has articulated his annoyance, these pictures
are contributing to the creation of an intimidating, hostile, offensive
work environment.

yes no don't know 7. Everyone in James's department is often
involved in verbal joking behaviour with
sexual overtones. The new budget analyst
objects and asks for a transfer.
7. Yes. The new budget analyst in James's department has clearly
articulated his/her annoyance. The continuing verbal joking with
sexual overtones are contributing to the creation of an intimidating,
hostile, offensive work environment.

yes no don't know 8. Laura's co-worker remarks how pretty she
looks today in her new dress.
8. No, but as with all of these examples, if the co-worker's conduct
should escalate, and/or Laura objects to his/her remarks, even this
behavior could be seen as harassment.

yes no don't know 9. The saleswoman who visits the purchasing
agent on her regular call constantly
addresses the male receptionist as "honey"
and stares at his tight-fitting pants.
9. Yes. Assuming the male receptionist has articulated his annoyance
at being called "honey" and/or the "stares", this behaviour is
contributing to the creation of an intimidating, hostile, offensive
work environment.
